Terms and Conditions of Sale

(i) All prices listed or quoted are subject to change without prior notice; listed or quoted prices charged will be those current at the time of dispatch of the products.
(ii) Millen Homeware Ltd reserves the right to restrict or withhold the sale of goods on credit at its sole discretion and without explanation.
(iii) Millen Homeware Ltd may in its absolute discretion allocate any sum received from the buyer towards any invoice or amount owing by the buyer, whether goods supplied under this invoice or otherwise. Millen Homeware Ltd shall not be obliged to make such allocation at the time of receipt but may do so upon any subsequent accounting between the parties.
(iv) Any quotations of delivery times by Millen Homeware Ltd are made in good faith but are estimates and Millen Homeware Ltd shall not be bound by such quotation.
(v)Millen Homeware Ltd reserves the right not to accept an order placed by the buyer, or close any credit account of the buyer.
(vi) Any claim or dispute arising hereunder shall be subject to arbitration in accordance with the Arbitration Act (1996).
(vii) Millen Homeware Ltd has the right to unilaterally change these Terms and Conditions by 7 days in writing to the buyer.
(viii) Errors and omissions excepted.

Shortages, Damage or Loss in Transit

(i) Liability for shortages in the quantity of goods delivered is limited to making up the shortages. No claim for shortages in quantity will be allowed unless the customer gives notification of the shortage in writing within 7 working days of the delivery and provides a reasonable opportunity for Millen Homeware Ltd to investigate the case.
(ii) Goods leaving Millen Homeware Ltd premises are adequately and safely packed. Claims for damage or loss in transit must be made against the carrier in the following manner:
(a) Prior to acknowledging delivery to the carrier the buyer must ensure that the complete consignment as per the carrier’s note has been received.
(b) Should there be a shortage or visible damage to outer packaging the carrier’s note must be endorsed accordingly.
(c) Within 7 days of receipt of consignment the buyer must ensure that all goods received are in good order and condition.
(iii) No claims will be considered after 7 days of receipt of goods. While no liability for goods damaged or lost in transit will be accepted by Millen Homeware Ltd, details of any claim should be advised to Millen Homeware Ltd.
(iv) Millen Homeware Ltd may in its absolute discretion unload goods at any premises that the Customer nominates for delivery. If the Customer is not in attendance at any nominated premises, Millen Homeware Ltd may leave any goods and shall not be responsible for any claims, damages, costs, or expenses arising or resulting there from including any claim that the goods were not delivered

Warranty and Refund Policy

(i) Merchandise may be returned or exchanged for store credit only in the case where the product is proven to be faulty and must be accompanied by a receipt.
(ii) Requests to return goods must be submitted within 7 working days from date of supply and the original invoice number must be quoted.
(iii) Where goods are accepted for credit they must be delivered at the buyer’s expense into Millen Homeware Ltd store from where they were purchased in original condition and packaging.
(iv) Goods to be returned must be in their original unused condition, specifications and packaging, along with any accompanying accessories or instructions together with the invoice and/or packing slip accompanying the goods. Goods cannot be returned if they have been damaged, altered or modified.
(v) Millen Homeware Ltd reserves the right to levy a restocking fee against any returns they may agree to accept. Such fees incur 20% of the purchased price and levied at Millen Homeware Ltd’s absolute discretion.
(vi) Custom made goods or special orders are not returnable, exchangeable or refundable.
(vii) All returns must be brought to our store, by the customer at their expense, for inspection before any refund is granted.
(viii) Where the goods are faulty or damaged due to manufacturing faults we will. (a) Repair the product (b) Replace the product if repair is not possible, or (c) give you a full refund not exceeding costs of Product at time of purchase. Manufacturing defects do not include normal wear and tear or any damaged caused by accidental or non-accidental damage.

Liability and Maintenance Guarantee

(i) We guarantee that all products sold are of acceptable quality within the terms of the Consumer Guarantees Act and that the products are fit for their intended use, acceptable in appearance, free from minor defects (apart from those which are drawn to the attention of the consumer) and are safe and durable (as a reasonable consumer fully acquainted with the state and condition of the goods, including any hidden defects, would regard as acceptable).
(ii) Millen Homeware Ltd is not responsible for the quality of work carried out on the products by the consumer or their tradesmen, and is not responsible for the design and construction of any structure in which the products are incorporated.
(iii) Consumers are strongly advised to call a qualified tradesman such as a builder, installer, electrician, plumber or gas fitter, where expert services are required.
(iv) Millen Homeware Ltd will not be liable for any consequential loss howsoever arising from the use of the products sold.
(v) Millen Homeware Ltd will not be liable for any loss caused by defective or inadequate structures in which the products have been incorporated.
(vi) Millen Homeware Ltd is not liable for damage from misuse, accident, neglect or improper operation, maintenance, installation, modification or adjustment.
(vii) The buyer shall be solely responsible for obtaining any necessary permits under and for compliance with all legislation, regulations, by-laws or rules having the force of law in connection with the installation and operation of the goods.

Sales Polices

3. Goods to be returned must be in resalable condition and contained in all their original packaging.
4. Some items are not returnable, exchangeable or refundable e.g. special order / custom finish items.
5. All returns must be bought to our store, by the customer, for inspection.
6. Our merchandise must be installed by qualified trades person for normal household practical use only.
7. Abusive usages or unqualified installations voided our warranty. Shower tray best with filled filler but must be sealed down onto the floor
8. Our warranty is back to base only, not liable for all other cost or delivery back to us unless you pay $50 extra for on-site repair.
9. Vanity damaged due to insufficient sealant or next to bath tub voided warranty.
10. Customer must check merchandise before leaving and we are not liable for damages if you failed to do so.
11. Customer must inspect colour before payment and we are not liable for wrong colour if you failed to do so. 7% cancellation surcharge for paid invoice on Lay Buys sales.
