Returns Policy

1. If you are making a purchase from our Websites and Platforms and our Stores and Services ofgoods or services of a kind ordinarily purchased for personal, domestic or household use orconsumption and if you do not purchase the goods or services, or hold yourself out as acquiringthe goods or services, for the purpose of:
(a) resupplying them in trade; or
(b) consuming them in the course of a process of production or manufacture; or
(c) in the case of goods, repairing or treating in trade other goods or fixtures on land,then you are our Consumer Customer and our Returns Policy shall apply.

2. If you are making a purchase of goods or services from our Websites and Platforms and ourStores and Services for business purposes as defined in sections 2 and 43 of the CGA, you agreethat the consumer guarantees provided for in the CGA will not apply to the supply of those goodsor services. You are our Commercial Customer and this Returns Policy does not apply. Pleaserefer to our Sales Terms for Commercial Customers.

3. WHEN YOU CHANGE YOUR MIND: We reserve the exclusive right to accept or reject at our solediscretion (for any reason whatsoever and in whole or in part) your request for refund orexchanges if you have changed your mind about a particular purchase.

4. YOU ARE PROTECTED UNDER THE CONSUMER GUARANTEES ACT 1993: You haveguaranteed legal rights for goods or services you buy under CGA. These are called 'consumerguarantees'. This Returns Policy is not intended to exclude or limit any rights which you may haveas a consumer under CGA (except to the extent permitted by the CGA) or to exclude liabilityarising under any other statute, and may not necessarily describe all right you may have. If thegoods or services we supply do not meet a consumer guarantee, our Returns Policy shall bemodified to the extent necessary to give effect to the above intention. These consumerguarantees are in addition to any warranty offered by a manufacturer, and you may have rightsagainst the manufacturer directly.
(a) The CGA does not apply where the goods have been used in a manner, or to an extent whichis inconsistent with the manner or extent of use that a reasonable consumer would expect toobtain from the goods; and the goods would have complied with the guarantee of acceptablequality if they had not been used in the manner or to that extent.
(b) If you are acquiring goods (or services) from us for business purposes as defined in sections2 and 43 of the CGA, you agree that the consumer guarantees provided for in the CGA willnot apply to the supply of those goods or services.
(c) We do not provide any express guarantees (as that term is defined in the CGA) other thanthose expressly confirmed in the Terms.

5. IF OUR GOODS FAILS OR IF OUR GOODS GET DAMAGED IN TRANSIT: If any goodsordered by you arrives damaged or is not of acceptable quality, please contact us within three (3)Working Days of delivery (and email to us copy of the receipt for the purchase if you purchasedthe goods from our stores).
(a) If the goods we supply do not comply with a consumer guarantee, but can be remedied withina reasonable time, we will either repair the goods or replace the goods with goods of identicaltype. If we cannot repair or replace the goods within a reasonable time, we will provide youwith a refund of the purchase price.
(b) If the failure in the goods cannot be repaired or cannot be repaired within a reasonable time,or where the failure constitutes a 'failure of substantial character' as set out by section 21 ofthe CGA, you are entitled to return the goods and choose to have a replacement of thereturned goods or a refund. Alternatively, you may elect to retain the goods and obtaincompensation for the reduction in value of the goods. Where you choose a replacement, wewill where available, provide goods of the same type and similar value to the returned goods.
(c) Please arrange to have the damaged item returned to us. If you are not in a position to comein to return the damaged item, you have the option to ship the items back to us at your cost.Please contact us to find out if you can ship your items instead of coming into a store. We willreimburse your shipping costs to return the original goods to us, where we consider the goodsto have breached a consumer guarantee. If on examination of goods returned to us, thegoods are found to not be in breach of any consumer guarantee, we will not repair or replacethe goods, we will not refund the price to you, and we may charge you a fee for examining thegoods, and we may decide not to reimburse you any cost to return the goods to us or ship theitems back to you.
(d) We will either repair or replace the goods or refund the price to you, at our election. Damagedgoods must be returned to us in the condition received by you with all original packaging,together with all packing slips.
(e) Please note that goods must be returned within a reasonable period and you may be asked todemonstrate that you have purchased the goods from us and that the problem with the goodswas not your fault.
